Giles Bark-Jones and Maria Stalbow of Bark&co acted for a suspect who was investigated for 3 years by the SFO in relation a major bribery and corruption matter. The allegations dated back to between 1996 to 2004 and are said to have taken place in multiple jurisdictions including Nigeria, Saudi Arabia, Malaysia, India and Brazil. The investigation centred on a company Foster Wheeler which had subsequently been purchased by two other companies to become Amec Foster Wheeler Energy Limited and then Wood PLC.

The team were vigorous in defending the allegations throughout the various stages of the investigation and the SFO confirmed that they would no longer be pursuing our client following a Deferred Prosecution Agreement (“DPA”) which it agreed with Wood PLC. The terms of the DPA included penalties amounting to UK £103 million which forms part of a US $177 million global settlement with the UK, US and Brazilian authorities.

The DPA makes it abundantly clear that it is solely relates to the culpability of the company Amec Foster Wheeler Energy Limited and not of any individual person.
